I am assuming this is a WA. case. I am assuming that you are covered by Industrial Insurance / L&I in WA. IF so, an injured worker injured because of the fault of a person not his employer / co-worker a third party, may receive L&I benefits and then also elect to make the third party civil claim. You have to contact the Third Party Section of L&I in Oly. at 360 902 5901 to tell them you want to elect to pursue the third party civil claim on your own (versus the L&I selecting a lawyer to do it on your behalf you don't want that). Third Party will send you the written election form. You should promptly contact a lawyer who does injury cases because you are going to need help coordinating the civil claim and the L&I claim, and then settling up / resolving the L&I lien on the third party civil claim. The reason you make the third party claim is so that you can recover general damages for pain, suffering, disability. L&I does not pay for general damages only for med bills, time loss, etc.

If you have been served with a complaint seeking damages, you should absolutely consult with a lawyer in person or over the telephone, not here.  If you do not answer a complaint in a timely manner, the plaintiff can obtain a default judgment against you, provided the plaintiff meets certain procedural requirements.
