In California, you cannot compel someone to come from out of state to California. I seriously doubt whatever state you are requested to go to has any jurisdiction over you to compel you to go. If they pay for your air fare, hotel, per diem for food and missed day of work, tell him you'll come. If none of these were offered to you, it?s likely they are just trying to save money. For them to have any possible jurisdiction over you, they needed to get an out of state commission, or letters rogatory. You need to read the papers carefully and it would be best if you could show them to an attorney for advice as this advice is just general without actually seeing the subpoena.
