You state you want to sue for the car not having an airbag and then state it didn't deploy. I am confused, did the car have an airbag that did not deploy or did it not have one at all? Did the car dealer sell you a car "with" an airbag that didn't have one? As you weren't injured in the incident, the only real damage you suffered as a result of the car "without" an airbag is if the dealer failed to sell you what he said he did. Sometimes airbags do not deploy for a reason. They are designed to deploy in different circumstances.

Why would you sue your dear sister? What did she do or not do that contributed to the injury? If your son was horsing around, and fell, injuring himself, that is not negligence. Too bad Obamacare won't kick in soon enough. If you sister has homeowners' or renter's insurance, there may be coverage for medical expenses for any injuries that occur on the premises, regardless who is at fault.

To be liable in this situation, the injured party must show that the injury was due to your negligence. The mere fact it happened in your home does not automatically make you liable. If you have homeowners insurance let them handle it. Otherwise, you will have to decide whether to fight the lawsuit or settle.
