To the extent you were harmed/ the cost to replace the tooth, yes. It is what they call "res ipsa loquitur" or implied negligence when a bone is left in food sold to a customer.

If there's a PIP policy the first 10 thousand is exhausted. Retain an attorney on contingency fee which means you pay nothing unless you win.
