You may if you were injured. Commercial vehicle accidents Almost always covered by commercial insurance policies with higher limits. The carriers and the adjusters are usually more sophisticated because injury potential increases exponentially with 18 wheelers and large commercial trucks.   If you were injured you should, at the minimum, take advantage of a free consultation from a personal injury attorney who regularly handles commercial vehicle accidents.   If you were not injured you may not need the assistance of counsel and if your vehicle can be repaired, it is usually best to take it to the repair shop you prefer and let them deal directly with the insurance carrier for the dump truck.

You have two issues, contract law and tort law (personal injury). Was the horse sold via a verbal contract or written? Unless there is a stipulation on how the contract can be voided or terminated, then the sale of the horse is likely to be in full force. If the buyer of the horse was hurt while riding the horse, then they assumed the risk. However, if you sold a horse that had a propensity to throw its riders, you knew about it, but did not inform the buyer, then you may have an issue with both the sale of the horse and the personal injury claim.

The less than $200 charge was a criminal matter, which does not always equate to a civil case. That said, you have every right to make this guy prove his case, including all alleged damages, so that he can only claim his actual incurred damages and not a lot of exaggerated figures. If you had auto insurance at the time, you need to let them handle it for you. Otherwise, you can decide to settle with him or not. If not, the worst thing that happens is he files a lawsuit, in which case he will have to prove his damages to the court.
