You can sue the driver. Their insurance will have to defend them. Your lawyer will obtain more information and if they still are being stubborn about it, you can let a jury decide who had the green light.

The insurer paying for a rental car during the time of repair equates to paying for your loss of use of your car. The law in WA. is that the person in your situation the sitting duck is entitled to loss of use of his / her car during the reasonable time it takes to effect repairs. The reasonable time may, obviously, include the time it takes to get parts in to the body shop. Don't give up. Stick to your guns. If the liability insurer wants to jerk you around, then I suggest 1) Check with your own insurer to see if you had rental car coverage on your own car, 2) If so, that is a not fault coverage and you should use it, 3) If you don't have rental car coverage, and the liability co. is continuing to be difficult, either turn the car back in or pay for the balance your self. Then, include what you have lost in your overall liability claim against the at fault driver and insurer, particularly if you also have a bodily injury claim.
