No. They can only get an award for costs, such as filing fees. If you have a contract with them that has an attorney fee provision, then perhaps yes. You need to look at the contract if there is one.

While there may be negligence on the part of the Walmart employee, the issue is one of the damages you suffered.  I would encourage you to gather your medical bills together and if you missed work, then you would also have lost wages.  If you have long term brain injury that is a whole different issue.

After an auto accident you should always take these actions: get checked out by a healthcare provider (always); report the accident to your insurance company, but do not give them any information concerning your health at this time (your own insurance company may become a defendant in a potential lawsuit against the at-fault driver); after you have been seen by a doctor (which should occur within 24 hours of your accident) contact a personal injury attorney in order to evaluate your case (personal injury attorneys will not charge you to evaluate your claim).
