Will my daughter have to have a GAL to handle her money and why not me her legal mother?

I hope your daughter is recovering nicely. In Oregon, a GAL is the appropriate way to retain an attorney for a minor, otherwise there is not a valid contract. A parent is often appointed as the GAL for their children. Once a case is ready to be either settled of a successful result has been obtained through a trial or arbitration a Conservator needs to be appointed to keep track of the funds. This can be a parent, but is not always one because sometimes a parent cannot get bonded because of either prior financial issues or maybe a criminal record etc. If you believe your daughter's attorney is lying to you that is a big concern. Even if he/she is not lying, you seem to not trust them for some reason. So it sounds like you need to have a meeting with your attorney and get your questions answered so that you are satisfied and trust them, or you need to fire them and retain new counsel for your daughter. Remember this is your daughter's case and you need to look out for her interests.

As long as the car was insured, the insurance company will address all of this.  It is very common, and is nothing that you should be making your self sick over.  So the chance of you being able to successfully counter claim for anxiety is not a good one.  The spouse filing a claim is also very common, so beyond what you have put in this quesiton, there is nothing that should be causing the level of anxiety that you are suffering.

Generally, if you cannot settle with the other vehicle's insurance company then you sue the driver, not the insurance company. There are very few situations in these types of cases in which you can actual sue the insurance company itself. The insurance company will hire an attorney to defend the driver and will pay, up to its limits, if you go to trial and obtain a verdict against the driver. Besides the driver you might also, depending on the circumstances, be able to sue other people or entities such as the owner of the vehicle or the driver's employer if the driver was working at the time. So to answer your Question, yes you can "sue the party who caused the accident personally if his insurance company" will not offer you enough money.
