Nebraska law does not require the at-fault party's insurance company to pay your medical expenses as they are incurred even if liability is established. While the at-fault party's insurance company could "advance" pay medical expenses, this is very uncommon. Generally, the at-fault party's insurance company will pay your medical expenses (or repay you, your health or car insurance company) when either you settle your case or if you go to court and obtain a verdict. In addition, the at-fault party's insurance company can deny that some or all of your medical expenses are related to your motor vehicle accident. If you disagree then you would have to sue the at-fault driver (you cannot sue the insurance company itself) and then let a judge or jury decide what medical bills are related to your accident. If you have additional questions you might want to talk to an attorney. Most personal injury attorneys offer a free initial consultation so it will not cost you anything to learn more about your rights and options.

There is probably no case here. First, you would have to show that the hospital was negligent in dropping or placing the pin on the floor and failing to remove it, or that the hospital knew about the pin and failed to remove it. The hospital is not automatically liable for all accidents that occur on its property unless it breaches some duty of due care to the public. Second, you cannot recover damages for harm that might occur, or that could have occurred such as infection. Some businesses pay for medical treatment for accidents that occur on their premises regardless of whether they are liable to promote goodwill with the public.

You don't specify if it is a criminal case or a civil case. Each State has laws that vary from jurisdiction to jurisdiction. You will need to retain Florida counsel or risk having the matter go against you. The circumstances of your defense is a defense, it is not a basis for not answering the charges. Your contract may not be legal in Florida if it is against the law. Good Luck. Do not ignore the issue.
