If you haven't filed a lawsuit yet it's as easy as sending the attorney a letter firing him/her and requesting your file be returned. If suit has been filed then you will need to execute a Substitution of Attorney. Be advised that your retainer agreement probably provides for the attorney to be able to recover the reasonable cost of his/her work plus costs, in such a case you must demand that the attorney provide you with an itemized invoice of his/her work and the rate as well as a detailed description of any costs claimed. Yes, if your case has value, other attorneys will consider taking it.
