What compensation I am entitled after being brutally beaten with a pistol while working alone overnight at a large gas station?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
You raise two issues. One is workers compensation. As far as a compensation for your injuries from the attack, workers compensation is your exclusive remedy against the employer. Your compensation depends on your average weekly wage and your treating physician's opinions regarding how much the event impairs your ability to carry out tasks that are work related. If you do not have an attorney helping you, I'm certain you can find one via the internet or yellow pages. Regarding sexual harassment, if is from your employer, there are things you should do before filing suit, including reading any written sexual harassment policy that your employer has and filing a complaint in whatever manner the procedure sets out. If that fails, file a complaint with the EEOC. You should try to get a consultation with an employment discrimination lawyer.

There are supposed to be protections in place, especially as far as children are concerned, though it can be possible for rules to be broken and for people getting away from things they shouldn't. I'd have to see the paperwork to advise you properly. Find an experienced lawyer in your area who handles these types of questions; maybe your local bar association has a referral service. It will be worth the cost of an office consultation for you to get the advice you need.
