IF you can prove this was caused by Publix.....possibly. Bear in mind that in most cases they will reject such claims absent some clear evidence that support your claim and hopefully you still have theglass piece so they can analyze it. As you might imagine many people fake such claims trying to get money from retailers.

While some of it is true, it is very misleading. You can file your own complaint. I suppose you could file for summary judgment on the issue of liability, but personal injury attorneys rarely do this because it accomplishes very little. If you obtain Summary Judgment on the issue of liability, the Judge will not enter a judgment within a month because the defendant is still entitled to a jury trial on the issue of damages. In my early years as a PI attorney, I got beat up by experienced defense attorneys on cases where liability was admitted, but they were arguing that my client simply was not hurt. In one case I got a zero verdict, in another I got a $1,000.00 verdict where my client had $20,000.00 in medical bills. The Defense attorney argued that my client's hurt back was idiopathic (a medical impairment that has not cause in the sense of an accident, like arthritis that just comes with age) and not caused by the accident. Mind you this was after I had graduated law school, passed the bar, and tried cases for 8 years as a prosecutor. Even now after over 25 years of practicing law, I still go to seminars and read books on proving damages so that I can better present damages evidence and arguments to jurors who are increasingly skeptical of Plaintiff's claims of pain and suffering from injuries. Whoever is telling you to file your own case is giving you very bad advice. Unless you are an exceptional genius, you cannot competently represent yourself.
