It is hard to know exactly what you are asking. If you are asking about whether there is still a criminal/ traffic case against you, it appears that there is not. However, the accident still occurred and you are still liable to the person for any injuries or damages he or she sustained as a result of the accident. It does not matter if a ticket was issued or if it got dismissed because the witness did not show up. The criminal/ traffic citation is separate from your civil liability. If you were at fault for the accident, you (or your insurance company) still owes the victim for his or her damages. In addition, the accident still may cause your insurance rates to rise even if the ticket got dismissed. Again, they are separate issues. Surely you can sue the drunk. The question is does he have insurance? Most drunk drivers aren't worth a judgment and if he doesn't have insurance you may be wasting your time.

Remarkable. If memory serves, this is the second time I've heard of someone finding a knife in their sub. I think the other one was about two months ago. Maybe you could search other questions on this site. Anyway, go to a dentist and get a written estimate on what it will cost to fix the tooth, then make a claim against the restaurant for that amount, plus five thousand for your inconvenience. If they offer you the dental bills plus one thousand, take it. If not, take then to small claims for the maximum jurisdictional limit in your area.
