Ask yourself whom the medical care was for and you can answer your own question. Yes, it depends on the fee agreement you signed with your attorney, but usually the client's portion of any settlement or award, if any, is paid after all medical bills, costs of litigation and your attorney's fees are paid. Usually we attorneys are paid our 1/3rd or 1/4th, or whatever was negotiated, "off the top', a term used to denote 'from the gross amount received', (i.e., before any other deductions are done). However, this payment method is not set by law and is negotiable between client and attorney in each case. Litigation costs include, but are not limited to, filing fees and other court costs, deposition costs, expert witness fees, research costs including computer research costs, paralegal and legal assistants fee costs, postage, telephone, travel, messenger, and any other costs reasonably incurred during the preparation of the case.
