What can I do if I got bit by a dog at a mechanic shop?

Answered by attorney Andrew C. Sigal (Unclaimed Profile)
Personal Injury lawyer at Law Offices of Andrew C. Sigal
You have a claim against the mechanic shop if the dog belonged to someone associated with it. In California, there is strict liability on dog bite cases. You should consult with an attorney, who specializes in personal injury litigation.

Do I have a case if my 4 year old son had to go under general anaesthesia for 2 hours and then had complications?

Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
"Complications" is the right word here. It sounds like you want something done immediately, and that just doesn't happen. Dental malpractice cases are always difficult to prove, as well as expensive and time consuming. You will have to be able to prove a failure to conform to accepted practice, resulting in the problems you have described. expert witness testimony is required for that reason, and of course an expert would have to review a complete set of the dental records in order to formulate an opinion. Sometimes difficulties and complications come about no matter what the dentist does, that's just the nature of human physiology. From what you have described, I can't tell whether this ordeal is the result of errors by the dentist, or simply the way this procedure happened to have turned out. I know, the tooth stumps and the swelling look horrible, but sometimes these things look worse than they really are. The 2 grand is a hard hit to take, but at least you HAVE insurance, unlike many of us. There will be other vacations. You sound like you are in your 30's. When you get older, you'll understand that sometimes you just have to take these things in stride.

How long do I have to file for charges against a lady who rear ended us?

default-avatar
Answered by attorney Jeffrey Lapin (Unclaimed Profile)
Personal Injury lawyer at Lapin Law Offices
I assume by "charges" you mean make a claim against the woman or her insurance company for any injuries or damages sustained in the accident. If you mean criminal charges, you can always call the police now. They would decide, what, if any, charges, to file against her. If anyone was injured or there was over $1,000.00 worth of damage to your vehicle, then both drivers are required to complete and return to the Department of Motor Vehicle- Financial Responsibility Section, a "Driver's Motor Vehicle Accident Report." This Report must be filed with the DMV within 10 days after the accident. If you want to go through the woman's insurance rather than deal with her, which is your right, you can contact her insurance company. I would recommend doing so as soon as possible because if you wait too long, and assuming she did not report it to them, they might deny coverage due to lack of notice. If she gave you her correct information and she did have a policy in effect at the time of the accident you can deal with the insurance company in resolving the claims, the damage to your vehicle and your injury claim if you were injured. If the information she gave you was wrong or she did not have insurance coverage at the time, you should contact your own insurance company if you have not already done so. They also need to be notified about the accident as soon as possible. If the other driver is not insured, any injury claims could be handled under your "Uninsured Motorist" coverage. For damage to your vehicle, you would have to go through your "Collision" coverage and would have to pay any deductible as set forth in your policy. If you do go through your own insurance company, either you or your insurance company can still go after the other driver. If she will not voluntarily pay, she can be sued. If you want additional advice I would suggest calling an attorney. Most car accident attorneys offer a free initial consultation so it will not cost you anything to learn more about your rights and options.
