What are my rights after I have a work related injury caused by third party?

Not true. You have a personal injury case that has some serious value depending on how it is handled. Of course workers comp will take a piece of the pie since they are paying for your medical and indemnity payments. So you need to pursue the case before the two year statute of limitations expire. Good Luck.

Can I still file for assault if the incident happened a month ago and there are no evidences but have two witnesses?

The police are not going to be interested. See if you can get an older member of the family to sit down with the two of you for a peace talk. No accusations, no recriminations, no retribution. Just, can you leave each other alone from now on.
