Under normal circumstances, the short answer is "yes." You should call your insurer and immediately report the incident.

You need to unwind the relationship and not allow her to drive the car. Get it either out of her, or your name. Get separate insurance policies. Split the real property. She is a liability waiting to happen and there are clear avenues, under your current circumstances, to attack your assets for the damage she causes.

Do I have a case?

John Joseph Ratkowitz
Answered by attorney John Joseph Ratkowitz (Unclaimed Profile)
Personal Injury lawyer at John J. Ratkowitz
Unless you were eating a cherry, you probably have a case, since your assumption was that you would not find a pit in whatever you were eating. I suspect that the restaurant is taking the position that the company that supplied them with the product was the real negligent party.Nevertheless, the restaurant owed you an obligation to serve food that was safe for consumption. Contact a local PI attorney. They will get to the bottom of who the appropriate insurance company is, and submit a claim on your behalf. It should settle without the necessity of litigation.
