How long is an accident considered valid to report?

Answered by attorney Gary Lee Platt (Unclaimed Profile)
Personal Injury lawyer at Gary Lee Platt
You don't say how much the other driver wants you to pay. If more than $500 damage was caused to any vehicle in an accident, or if there is ANY injury to a person, you are required to report the accident to the DMV within 30 days of the accident, so if you haven't done so already, do it IMMEDIATELY. You need an SR-1 form from the DMV, which you fill out and mail into the DMV in Sacramento. If you had insurance coverage at the time of the accident, you also need to report the accident to your insurance company immediately, since they need to investigate and, if there is coverage, they will pay the damages on your behalf. If you do not have insurance, you can be sued for the damages by the other driver, unless you pay what he is asking for.

Can an attorney take a settlement without the clients consent?

default-avatar
Answered by attorney Kevin Marc Habberfield (Unclaimed Profile)
Personal Injury lawyer at Black, Lyle & Habberfield, LLP
If you have insurance you will get no fault benefits for medical treatment for 3 years or $50,000, whichever comes first. This is regardless of whether you settle your claim or not. You likely have a UM (uninsured motorist claim going) with your own company as the other driver was uninsured. No attorney can settle a case without your consent because you must sign a release. If you are not happy, do not sign the release. Either way, talk to your attorney and get this all cleared up.

Can I file for pain and suffering or personal injury against the trainer that hurt me during my correctional officers training?

default-avatar
Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
Have you asked your comp lawyer about this? You can't sue the trainer if he was a fellow employee. However, if he was a private contractor or worked for an outside agency, then yes. But: this happened in 2011, and now it's 2014, statute of limitations may have passed. In NY it's 3 years.
