What can I do if I am being sued for an accident that I couldn't help?

Thomas C. Bulman
Answered by attorney Thomas C. Bulman (Unclaimed Profile)
Personal Injury lawyer at Bulman Law Associates PLLC
You are learning the very expensive lesson for what happens to people who drive without insurance. You failed to maintain proper distance and therefore are the most responsible for the collision. At this point, you will be representing yourself. Never fail to answer any court related document you are served or receive in the mail. You can slow the process down. They may give up after they settle the UM coverage your victim has.

What should I do if I fell on a wet/slippery spot on a restaurant floor?

William H Nebeker
Answered by attorney William H Nebeker (Unclaimed Profile)
Personal Injury lawyer at Havens Law, LLC
The Restaurant is liable for injuries arising on the property when you enter their premises. You are owed the highest duty and thus they have an obligation to protect you from dangers they know of or should have known of. It is important that you document your case as you move forward, pictures, doctor bills, logs of your pain etc. The Restaurant may want to settle your case, pay for your damages, until you show them what your damages are they won't pay you. Call or email to start your case, depending on how you approach the restaurant and how you draft your damages will determine how successful you will be against the Restaurant.

Who is liable if someone falls outside the building I run my business in?

default-avatar
Answered by attorney Donald Keith Broad (Unclaimed Profile)
Personal Injury lawyer at Broad Law Firm, LLC
It depends upon what the terms of your lease are. Generally, landowners are responsible for any defects on their own property, but landlords often pass that responsibility to their business tenants in the terms of the lease. Also, if the fall occurred on a public sidewalk in a city or town, it is possible that the city or town could have some liability as well. You should consult a local attorney to have them review your commercial lease and should also review the facts of this incident with your Commercial General Liability Insurance agent.
