What to do after getting a jaywalking ticket?

Paul L. Whitfield
Answered by attorney Paul L. Whitfield (Unclaimed Profile)
Personal Injury lawyer at Paul Whitfield and Associates P.A.
Jaywalking is about as serious as overtime parking. No points on license and no increasein insurance involved. You give me the impression you might be a little of a smart alec, tell your story to the judge. Be a nice guy. Resist the temptation to engage the officer on a personal basis and don't seem to be a smart alec in the courtroom. Let the judge know if your record is clean. Remember: it may be hard for you, but just be a nice guy, not a citizen looking to fight the police or the court.

Who would I ask to postpone my deposition?

default-avatar
Answered by attorney Gary Lee Platt (Unclaimed Profile)
Personal Injury lawyer at Gary Lee Platt
You should have received a Notice of Deposition from the attorney who is seeking to depose you. If you had a lawyer at the time, your lawyer should have this notice in his file. The first step is to request in writing that your lawyer give you a copy of your file. You are entitled to it, by law, and if the attorney fails or refuses to give you a copy of your file, call the State Bar of California immediately and report this attorney. Your file will have the name, address, and phone number of the attorney you need to contact to postpone your deposition. If you have the case number of your lawsuit, you can go to the court's website and find the name of the opposing attorney, then go to the State Bar website and enter the name of the opposing attorney, and get his/her address and phone number.
