What can I do to speed up my personal injury case?

Answered by attorney Steven A. Schwartz
Personal Injury lawyer at Joel H. Schwartz, P.C.
If you have a lawyer, your best bet is to make sure he or she is doing everything to keep the case moving. Has the attorney requested all records necessary to present a proper demand to the insurance company, or is the attorney sitting on your case? The quick answer is that there is a process you must go through to resolve a personal injury matter. If you are still treating, I would not encourage you to attempt any negotiation because you don't know the full medical picture. You would typically wait until you are at a medical end result. If you are under financial pressures and must settle quickly, you can certainly negotiate, but it is doubtful that you will get full value as you don't have all the evidence to present and the insurance company will take advantage of someone who is desperate. My best suggestion is that you contact an experience personal injury attorney in your area and express your concerns about resolving the matter quickly.

Am I liable to pay for medical bills incurred from a car accident?

default-avatar
Answered by attorney Robert Morrison Lucky (Unclaimed Profile)
Personal Injury lawyer at The Lucky Law Firm, PLC
Yes, legally you are obligated for paying the damages caused by your negligence. If you do not voluntarily pay the other party's damages, then he/she may decide to take legal action to have you pay for her damages. However, you mentioned that the other party did not have insurance on her own vehicle or the vehicle that she was operating. If this is the case, then Louisiana law provides under its "No Pay, No Play" law that if the other person cannot recover for the first $15,000 for property damage or the first $15,000 for bodily injury/medical expenses.

What can I do if I haven't heard from my attorney even after repeated email and phone attempts?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)
Personal Injury lawyer at Kelaher Law Offices, P.A.
Send him an e-mail that if you haven't heard from him within 48 hours that you're going to discharge him and seek representation elsewhere. The #1 grievance against lawyers is failing to maintain contact with clients, and return their phone calls.
