Can we sue for personal injury if a pedestrian was killed?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)
Personal Injury lawyer at Kelaher Law Offices, P.A.
Most people think that the investigating officer is supposed to make a finding of who was at fault in causing an accident, but that is not his job. What the investigating officer is supposed to do is make a determination as to whether one of the operators of the vehicle has violated some Florida law. A citation is issued to the person who the policeman believes violated the law, and that does not always equate to a finding of fault. Whenever a pedestrian is killed in a motor vehicle collision, the person who is driving the car is usually bears some of the responsibility for causing the accident. Only the personal representative of the estate of the decedent can bring a claim for wrongful death, so that person should contact an attorney promptly as there is a two year statute of limitations for wrongful death, and there usually is much investigation that needs to be completed before a lawsuit can be filed.

Can I sue for pain and suffering after a dog attack?

Answered by attorney Christopher Thayer
Personal Injury lawyer at Carney Badley Spellman, P.S.
You are entitled to be compensated for pain and suffering from the dog owner (or his/her insurer). The amount is not subject to any set formula, but is based primarily on the severity of your injuries, duration that you suffered any pain or disability, and the degree of permanency of any symptoms, disability or scarring. Whether or not either property owner (neighbor or landlord) are possibly liable as well would depend on additional facts. You should contact a personal injury attorney in your area.

What can I do if I got burns and scars in my arm using a resistered trademark hard wax used properly. Can I sue the product company?

Answered by attorney Christopher Largey
Personal Injury lawyer at Largey Law
I'm sorry to hear you have been injured using a hard wax product. If you have been injured using this product, in a manner as recommended by the product manufacturer, than you may have a valid claim.  If your injuries are minor and you are not going to need ongoing or future medical care for your injuries, you may want to contact the company directly and advise them of your injuries. they will probably pay a nuisance payment to you to make your case go away quickly. If, however, your injuries are substantial, you should contact an experienced personal injury lawyer and let them handle negotiationg with the insurance company of the product manufacturer. Make sure you keep the product and take pictures of the progression of your injuries every day until they are healed.   Good luck, Christopher R. Largey
