In response to your question, it is a misdemeanor to drive a motor vehicle in California without a license. Technically, one could receive a prison sentence at a county jail if convicted of this offense. As a practical matter, given the overcrowding of the jails, an offender would probably receive a fine.

An injury on the job is a workers' compensation matter. The law states that if the injury arose out of and in the course of employment, then it is a workers' compensation case. But the employer can defend against this case by arguing "initial aggressor defense" which states if the worker was injured on the job but the worker was the initial aggressor, then he will not recover. So, the question will be who was the initial aggressor. Your case value will depend upon the level of permanent disability so that if the injured worker has some P.D. the case has value.
