Truly and unequivocally unauthorized surgery can be the basis of a lawsuit but it might be labelled something other than malpractice, along with a malpractice claim. Sometimes though the patient impliedly gives consent. Also hospitals usually obtain your signature on a very broad release of liability which would have to be overcome in any lawsuit. I think you may have a valid claim but lots more facts need to be gathered. If it's not against the rules of this site, I suggest you call my office for an appointment sometime fairly soon, if you'd like us to evaluate your claim with you. Our law firm, like many others, retains a medico-legal expert to assist us in evaluating a case for malpractice. His review costs $500.00, and is worth it. But that is a cost, rather than a legal fee, so it falls on you to pay.

There is no such thing as giving a rough idea of what a case is worth. It is completely dependent on all the facts of the case. But a quick recovery and low medical bills would indicate a very small settlement.

Can I go back to my old Dentist to get them to pay for the repairs if they were not done correctly?

Yes, you may go back to your old dentist and ask if they will take care of the repairs for you considering the opinion of the endodontist. However, legally your dentist may not have breached the standard of care. Medical malpractice is a very difficult thing to prove. Considering you went 5 years with no problems, one may reasonably find that there was no immediate damage due to the manner in which the dentist performed the procedure. In fact, it may have been the appropriate depth when the procedure was initially done. You may wish to ask your endodontist if he considered the dentist's work to be malpractice. As stated earlier, you are always welcome to inquire about whether they will take care of the additional procedure considering the advice of the endodonist.
