Looks like you have a weak case. Problem is that the two rowing machines were right in font of you, and you saw them. Nothing was concealed from view. The fact that the machines were not there before does not help you, because you saw them before you tripped. In order to sue, somebody has to do something wrong, mere accidents are common, they happen to everybody, even under best of circumstances. There is no liability for accidents. If they offered 5000 that's pretty good given no broken bones, and pre existing disabilities. I doubt you will get much more if you sue, especially with no lost earnings, or severe permanent injury (like brain damage, or debilitating disease, or neuro injury, or visible facial disfigurement). You may have difficulty getting an atty because damages are small, and costs to litigate will probably exceed recovery. This is only my opinion, others may disagree. You should contact another attorney for 2nd opinion, or go to legal aid to see if they will take your case for free (pro bono). In any event you have to watch out for statute of limitations, which is running on your claim. If you wait too long, you will lose your claim. I can't give opinion on that because you did not provide the date of your injury. You need to find out st of limitations deadline from the attorney you contact next, and you should do that immediately, today if possible.

Assuming that your name is on the DMV title to the motor home, you should be protected, although it may require filing a lawsuit. I'm not clear about what you were saying about "holding the check". It is illegal in NC to write a check if you knew at the time it was written that there were insufficient funds in the account.
