You may have a case against the landlord - hopefully the landlord has insurance. I need a better understanding about the defect that caused the fall. The lack of railing could be a building code violation depending on whether the stair is used for ingress and egress.

Assessment of an appropriate settlement requires detailed analysis of liability and damages, including application of legal principles, evidentiary factors, medical documentation, out of pocket expenses, calculation of future losses and experience in your jurisdiction as to likely range of prospective jury awards. To answer the question properly, one would need extensive examination of all the evidence, particularly the medical records. It sounds to me like you are trying to second-guess your lawyer. Don't do that.

Can a dentist pull a tooth without giving antibiotics first?

In order to prove a dental malpractice case, a claimant has to prove a failure to conform to accepted practice, and resulting injury as well, and expert witness testimony is required for that reason. I know of no reason that antibiotics would be required in order to pull a tooth (in fact, I'm remembering a number of years ago when one of my own kids had some teeth pulled and I don't recall any antibiotics being used). Antibiotics are terribly over-used in a variety of contexts and this has led to the generation of ever-more antibiotic resistant bacteria. The administration of antibiotics would not have lessened the pain nor prevented the tooth from breaking. It was within the dentists discretion to refuse the prescription, he apparantly felt it was not warranted. You have not stated that there was any infection as a result. You have taken your daughter to another dentist to complete the procedure, right?
