If my husband was in an accident with life altering injuries and driver at fault is uninsured, what is our best recourse?

If you have an uninsured driver / vehicle that caused the injuries, and you have no other persons / entities to look to as liable parties, then you are going to have to go on your own auto Uninsured Motorist Coverage (UM), and your own auto Personal Injury Protection Coverage (PIP). PIP will exhaust with a limit of up to 10K, 25K or 35K, depending on which coverage limit you had in effect. Once PIP exhausts, then you go on your general health insurance coveage, such as Premera, Regence, Group Health, etc. Your spouse may also be eligible for Social Security Disability Insurance Benefits. If so, then your spouse is also going to be eligible for Medicare. Suggest that you consult with a lawyer who does injury / disability cases.

You are going to need to get your case to a benefit review conference because of the insurance company doctor saying you have no restrictions.  Your treating doctor should be able to address your work status, and can also refer you out for a second opinion if that is what you want.  If they have cut off your benefits, you need to discuss the situation with a workers' comp attorney immediately.

For starters, it is very difficult to sue an insurance company and win. Second, it's nearly impossibleunless you have them on tape or in print saying something which proves they knew something wasn't true to prove an adjust or "lied" about an investigation. Remember, there is a huge difference between an insurance company taking a contrary position which may be wrong according to what you think you know, and an adjustor insisting the facts are a certain way while KNOWING they are not. You call it a lie, they call it a difference of opinion, and if there is no hard evidence either way, a court of law is not going to rule in your favor.
