If their tanning lotion was a direct causer of our daughters death, can we sue the tanning lotion makers?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Personal Injury lawyer at Richard B. Jacobson Associates, LLC
I am terribly sorry for your loss. I believe in Wisconsin you can sue the manufacturer and the merchant. You will have to be able to prove your case: that it was the lotion which was the direct, proximate, cause of the harm. If you have the original container with the rest of the lotion in it, preserve it for a serious chemical analysis. Consult an experienced medical malpractice lawyer. My firm does that kind of case, as do three or other firms in Dane County.

Should the company’s insurance be responsible for the injuries or is he responsible for it?

Answered by attorney David E. Frank
Personal Injury lawyer at Frank Law Group, P.C.
If the accident occurred during the course and scope of his employment, company insurance should cover. If he was on a personal errand, then his insurance.

Can I still file for assault if the incident happened a month ago and there are no evidences but have two witnesses?

I DON'T THINK THE POLICE WILL CARE ABOUT A FAMILY DUSTUP BUT YOU CAN TRY TO REPORT THE MATTER. THE FACT THAT YOU WAITED MAY BE THE BIGGEST PROBLEM.
