Why do some attorneys send their representatives to court instead of going themselves?

That is how some law firms operate, the senior attorney running the office and taking in new clients and the associates handling the courtroom appearances. The system has its flaws, as you are experience, but it has its advantages also. Yes, changing lawyers could make the case take longer, but not necessarily. How long a case lasts depends on many factors. The decision as to whether you go back to work is a medical determination, not a legal choice. If your doctor says you are able to go back to work, then that's what you do. You also follow your doctor's advice if he/she says you can't go back to work, or if you can work but only with restrictions. If you can go back to work but you don't then that hurts your case.

What is the fair amount for pain and suffering?

Answered by attorney Steven A. Schwartz
Personal Injury lawyer at Joel H. Schwartz, P.C.
I am very sorry to hear about what sounds like a terrible accident. You have clearly been through, and continue to go through, quite an ordeal. I never advise anyone to try to negotiate their claim themselves with an insurance company. Understand that an insurance company is a business like any other. They are trying to make a profit, not pay out on claims if they don't have to. Almost always, they will take advantage of the unrepresented victim. I see many issues already with your situation. The biggest one being that you should not be negotiating anything at this point. You are still in the middle of treatment and really don't know what the future holds for you. You only get one shot at this, so if you are not adequately compensated for everything you have gone through and will go through in the future, you are out of luck. It has only been months since the accident. I would give your injuries more time to heal, so that you can see if there are truly any permanent disabilities from this. If there is, this will need to be documented properly to increase the value significantly. The Insurance Research Council has found that, on average, a person represented by legal counsel will receive 40% more in their pocket when the case resolves. Hopefully, that tells you something. Put it in the hands of experts who know how to work a case up properly to get you maximum compensation. You will be glad you did.

I am trying to figure out if i have any legal grounds to file a lawsuit against a hotel i stayed at for one night and was bitten by a brown recluse

Jonathan Wesley Johnson
Answered by attorney Jonathan Wesley Johnson (Unclaimed Profile)
Personal Injury lawyer at Jonathan W. Johnson LLC
I actually handled a brown recluse bite case for a person who lived in an apartment complex.  You may recover if you can show that the hotel had some reasonable notice of risk of this, such as prior complaints about spiders or evidence that some other person was previously bitten in the hotel.  If you can show that, you have a pretty good chance of recovering.  In my case, we were able to show tenant complaints about spiders and prior spider bite injuries and got a substantial recovery.
