There are side effects to every drug. Unless you have some lab expert to testify against the drug company you don't have much chance there. As far as the delay in diagnosis, you may have a case. you may not. it may not have been possible to properly diagnose the case earlier. what you need to do is find a doctor who will review all of your medical chart (yes, all, from start to finish about the pancreas) and tell you whether you have a case of malpractice or not. it will likely cost you a couple of thousand dollars to get thru this point. if the doctor says yes and if he will agree to testify for you then you can go forward with a malpractice claim. It is all uphill and you will need the best malpractice lawyer you can find. Good luck and best wishes on your treatment. Sorry for your pain.you have to remember that just because you have a bad situation it is not necessarily someone else fault. Fault is hard to prove in the medical field. You have 3 years to sue for ordinary negligence, 2 1/2 for medical malpractice. It sounds as if this is ordinary negligence. I mention this because you should see how you recover. Slip and falls are always liability issues, and if the injury is not significant or permanent, you may not find a personal injury attorney interested.
