Should I file a stolen car after the car got impounded?

Answered by attorney Jeffrey Lapin (Unclaimed Profile)
Personal Injury lawyer at Lapin Law Offices
Your question seems to relate to possible criminal charges being filed against you. I do not practice criminal law and cannot give you any advice regarding your potential criminal liability. I would strongly suggest contacting a criminal attorney to learn about your rights and potential liability. As to your civil liability, as it was your vehicle, which you did loan out, your insurance policy will have to pay any property damage or injury claims to the other vehicle involved arising from the accident. You also would have to use your Collision Coverage, and pay your deductible, for repairs to your vehicle. A vehicle's insurance policy is always primary over that of any driver. As to your potential personal, civil liability, over and above your insurance policy limits, you may be liable although more information would be necessary to be able to fully answer this question.

My Attorney says the check is sitting in his office. This has been months he never returns my calls. He has told me Medicaid is holding it up how tru

Answered by attorney Jonathan R. Ratchik
Personal Injury lawyer at Kramer, Dunleavy Ratchik, PLLC
Medicaid has a right to recover benefits it paid on your behalf and which are related to medical treatment you received for your injury.  And because Medicaid has a statutory lien, it could seek to recover the money from your lawyer if he released the settlement proceeds to you without paying Medicaid first.  That said, two (2) years does sound like a long time, even for Medicaid.  You might want to schedule a meeting with your lawyer to discuss the amount of Medicaid's lien and what efforts, if any, he's made to resolve it.  There should be a contact person at HRA / Social Services with whom he can speak.  If not, he could bring an Order to Show Cause to have the Court resolve the issue. That usually getst their attention.

Why can’t I take her back to court where the judge can do something about the loan?

Answered by attorney David E. Frank
Personal Injury lawyer at Frank Law Group, P.C.
If the court issued a judgment for the unpaid $700, you can garnish her wages. If you know where she banks, you can also do a bank levy. To accomplish this, contact the civil division of the sheriff's dept in the county in which you are located and they can help you with the necessary forms and fees.
