What can I do if I was fired because of injuries?

default-avatar
Answered by attorney Willie Stephen Graves (Unclaimed Profile)
Personal Injury lawyer at Graves Law Firm
You don't say whether you were hurt on the job, but if not and if you have no contract of employment or issued employee manual that says otherwise, your boss can fire you for any reason or no reason just as you can quit for any reason or no reason. It doesn't even have to be for something that affects your job performance, though your injury pretty clearly does.

Hoow would I know if I have a medical malpractice case?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
To successfully sue for malpractice, you need three things: 1. Evidence that the doctor/nurse deviated from acceptable standards of due care, either by act or omission. This is also referred to as negligence. A bad outcome, in of itself, is not evidence of negligence. You need a doctor to testify that the doctor/nurse was negligent. 2. Evidence that the negligence cause some harm. 3. Significant damages. If the negligence caused minor damages, it would not be economically feasible to bring a ,malpractice case, because the cost in expert witness fees would exceed your damages. Some malpractice attorneys who require at least $500,000 in medical bills or lost wages caused by the negligence before they will consider the case. If the second heart attack did not cause serious permanent damage (i.e. After recovery, he is much worse off than he was or would have been after the first heart attack, it may not be worth looking into. If you think the second attack caused significant damage, then the only way to know is to find a lawyer who can get all of his medical records and send them to a doctor to review. Someone will have to pay the doctor between $750.00 and $3,000.00 to review the records and give an opinion.

Is a HOA liable for illness due to fecal contamination in the pool

Answered by attorney Mark Tischhauser
Personal Injury lawyer at Tischhauser Law Group
Doubt it. It the people pooping in the pool that are causing the issue. As long as the property management people are taking reasonable steps to address the issue, thats all they are required to do. I am not sure that the added expense of people monitoring the pool would be required nor even effective to stop little Bobby or Granny May.
