Would I be correct in assuming you are female. Your social involvement with all these folks and facts seems to have little to do with a law claim. The question is: who is liable for the damage? what is the damage? concentrate on liability and damages. Most of this other stuff you comment on is irrelevant. You can file a small claim for any amount but you will be limited to proving liability and then proving actual damages if the work of investigating the claim is not to your like ngh tell the dudes boss or write a letter to the insurance commissioner.

You need a lawyer in your city to answer that. In most, probably all cities in New York State, you need to show that a notice of defect was on file with the city before you fell with enough advance notice so that they would have had an opportunity to fix it.
