Does an auto insurance personal injury adjuster have legal right to my medical bills without a signed authorization?

Answered by attorney Linda Weimar (Unclaimed Profile)
Personal Injury lawyer at Weimar Law Offices
Is this your auto insurance carrier, or the carrier for the at fault party. If your own, they are entitled to your medical bills if you want them to pay them under the Personal Injury Protection coverage of your policy. If the other driver's carrier, they are only entitled to medical records and bills that are related to your injuries or related to prior injuries to the same or similar body parts injured in the collision. However, they are not entitled to get the records themselves without a signed medical authorization, or if a lawsuit is filed, a subpoena.

Can I sue the fast food restaurant for having blood in my sandwich?

Answered by attorney Fred Lung-Kee Fong (Unclaimed Profile)
Personal Injury lawyer at Law Office of William S. Lindheim
I am so sorry to read that you had eaten some human blood in your sandwich. Nothing more abhors one more than eating another human body parts or contents. Your question is not new. There was a landmark case called Donoghue vs. Stevenson in 1932 which gave a plaintiff the right to sue the defendant for a factual pattern similar to yours. In the case of Donoghue, the plaintiff drank a bottle of soda and realized that a snail was inside and he was so grossed out that he became mentally ill from this incident. The plaintiff had the right to sue. Modern American law also allows such a law suit.

What should I do if my Protected Health Information was inappropriately disclosed by one of their employees twice?

Paul L. Whitfield
Answered by attorney Paul L. Whitfield (Unclaimed Profile)
Personal Injury lawyer at Paul Whitfield and Associates P.A.
What do you want to do? If you don't trust the people don't do anymore business with them. if you are looking for money out of the deal I don't think that will work. The HIPPA laws to protect privacy are mainly criminal type statutes and not designed to create money for claimants. Besides you would have to prove some damage. and what damage do you have other than hurt feelings at this point?
