Under Virginia law, there is no requirement that a fast food store manager (or any property owner for that matter) contact you if you had an accident on the premises. The fact that the manager (or anyone else) took information or wrote a report is for THEIR protection, not yours. Your health is the most important thing - get treatment before your injuries get worse due to neglect. The fast food store's insurance company is going to assert that you were not hurt if you did not see a doctor. You should also avoid giving any tape recorded, written or other statements to the insurance company or fast food restaurant. The surveillance tape may be critical evidence, which an experienced injury lawyer will be able to help you secure before it is destroyed or recorded over. Retaining an experienced and licensed Virginia personal injury lawyer who actually tries these cases on a regular basis and who has a real office in the Commonwealth would help you to protect your interests. Do they have a real office with live (not "virtual") staff. Check to see if they are ACTIVE, teaching & contributing members of the Virginia Trial Lawyers, DC Trial Lawyers and American Association for Justice (formerly the Association of Trial Lawyers of America). Many lawyers advertise that they handle cases in court, but I have learned that so many do not actually try cases in court, cut quick deals and are in fact scared to go to court. The best way to determine the best lawyer for your case is to see your present (or future) lawyer "in action" actually trying a case in court. Pick a professional not a pretender.

She doesn't need to sue you. Your homeowner's insurance covers you for these types of accidents, even if they don't happen at your house. If she contacts your homeowner's insurance, it should cover her bills. If the accident happened at your house, then your homeowner's insurance typically has medical payments coverage that will cover her medical bills (up to a certain amount, like $5,000 for example) regardless of who is at fault. Since you did not intentionally harm her, it was an accident and the bodily injury coverage of your homeowner's insurance should pay her medical bills up to the limits of your BI coverage. If she does end up suing you, your insurance should provide you with a defense.
