You do not determine it, it has been determined for you. Worker's comp pays your medical and a percentage of your average weekly wage over the 52-week period prior to your injury (In NY the percentage is 66.6%) If you have permanent partial disability, a schedule is applied, accounting for the part of your body injured, the degree of disability, the average weekly wage and the amount paid out to that point.
