Even with injuries as serious as yours, I would think $80,000 would be on the high side if that is what you are expecting to have in your pocket when all is said and done. Oregon is a pretty conservative state when it comes to jury awards. Your lawyer should be able to give you a good assessment as to what a jury is likely to do with your case and, therefore, calculate what your case is worth now.

You are responsible and since you did not have insurance you will have to pay. The question is how much. If you don't have many assets and not much to get I doubt they will pursue the claim very hard. You maybe able to negotiate a better deal or see if they really file a lawsuit against you.

All property owners and business operators are responsible for keeping their property in reasonably safe condition. If the restaurant managment knew or should have known of the hazard and failed to take steps to correct it, even though they had time to do so, then it can be held legally liable for injuries that could foreseeably result.
