I don't think you know what you are talking about. If an insurance company paid the property damage and paid for"pain and suffering" they would have required a release to be signed. No one would file a lawsuit in the face of a release. It would be a total waste of time and money.If anyone ever serves papers on you take them immediately to your insurance co. it is their job to take care of you when suit is filed

First she sees her doctor because her health the most important thing in this matter. Then you have six months to file a claim for personal injuries with the city clerk. You can obtain the claim form on line or form the City Hall. If you do not file your claim within six months, you have lost your chance to file a claim.

Yes, this is a no-fault claim and this is why it is called "no-fault". Important: make sure all the paperwork is filled out and submitted promptly. Insurance companies live on paperwork and their one hope to get out of this is to find some technicality that they can use as an excuse to disclaim. Keep copies of anything you send to the insurance company. Once this is all set up, the medical providers can send the bills directly to the insurance company and they will pay the providers directly and you don't even see a bill. Once in a while there will be a discrepancy and the doctor's office forgets to send something or the insurance company wants some clarification, but if it does, just grit your teeth and get them whatever they need even if you know darn well that they already have it. The good news is that your daughter is entitled to coverage for whatever medical attention she needs, including tests, therapy and prescriptions, as long as the doctor signs off that it is medically necessary and due to the accident. You don't need a lawyer for this, but you do have to pay attention to the details.
