Can I still file for assault if the incident happened a month ago and there are no evidences but have two witnesses?

You have a year to ask a magistrate to issue a warrant charging her with battery. It sounds like she will then have one issued for you. My advice would be to stay away from her.....no contact!

Do I sue the person or the company of the person who hit me?

You need the name of the driver or the owner of the car. You can sue either one or both. You'll need a plate number or information from a police report or that you obtained at the scene. Also, sometimes, when insurance companies write to you on automobile cases, they put the name of the "insured" in the subject lines of the letters. That person is usually the owner of the car.

Is there anything I can do on my nephew who is on probation for drugs and alcohol and admittedly steal things from the family?

David F. Stoddard

You could report what he has done to his probation officer, who could take him to court to revoke his probation. However, the probation officer might not do this on the basis that it is your word against his. You can call the police and try to have him arrested for stealing your things, but you again may have the same your word against his problem. You could move out.
