"Should it" is one thing; "Does it usually" is another. Theoretically, it's so simple, it should be resolved very easily: take a statement from you, take a statement from the employee, interview any other prospective witnesses, get together documentation as to wage loss, injuries and medical expenses, and that's that, right? But, here's the reality. On the one side there is you and your lawyer, on the other side is the claims representative, the supervisor and the restaurant. Your lawyer has many matters to handle, so does the claims adjuster. Just getting a phone call together could take a minute, or a week. There are file reviews, interruptions, and "I'll get back to you". If the matter is in litigation, then the insurance company hires lawyers to represent the restaurant and we have to go through procedures including witness lists, document production, legal research, scheduling depositions, on and on. So, yes it can easily take a year without litigation, and add two more if a formal lawsuit is filed.
