Can a legal malpractice attorney represents you without written contract at trial?

It's legal, but puzzling: why would you have someone represent you at trial, if that was not your intention? Why would they represent you if they did not have your consent? They are supposed to have a written contract (retainer) in order for the fees to be enforceable, but a court may award them reasonable fees on an equitable basis.

Do I have a case if I had da Vinci robotic surgery in 2013 for a hystorectomy that caused my heart to stop and ovaries could not be removed

There is no clear cut answer to your question.  Most surgeries have risks and doctors are trained to explain them to you.  No surgery guarantees sucess and there are always risks associated with surgeries.  Unless it was an emergency procedure, I'm sure that you had a pre-surgery physical exam which cleared you for the surgery. it doesn't sound like you have a claim.   Michael Barasch Barasch & McGarry 212-385-8000

What is a fair amount for my settlement?

default-avatar
Answered by attorney Jeffrey Lapin (Unclaimed Profile)
Personal Injury lawyer at Lapin Law Offices
There is no "magic formula" to determine the value of a case. Each case is different and dependent on its own facts. There are a number of different factors that determine how much money you are entitled to, including, but not limited to: whether an injury is permanent; how the injury affected you while you recovering; medical expenses; lost wages; pain and suffering; and inconvenience. If an injury is permanent, you are entitled to money, if applicable, for these items in the future as well. You calculate future damages ("money") based on projections/ estimates and your life expectancy. I cannot answer your question ("What is a fair amount for my settlement?" without a lot more information about the items set forth above. I would suggest contacting a personal injury attorney to discuss your case. Most offer a free initial consultation and you can get more information about the value of your case.
