You should immediately call a lawyer and discuss your case with them.  There are related issues of how to attempt to file supplemental police report as well as hiring an accident reconstructionist in order to try and prove the liability in your case.  Most attorneys who do this type of work will give you a free consultation.  Give one a call.  Do not discuss your case or give a recorded statement until you have consulted with a lawyer. Your insurance company will have a right of subrogation as to any monies you recover if you can prove liability.  You should gather your medical bills and (EOBs) together and bring them with you or mail them to the lawyer you speak with.

Notify your insurance company, get a claim number and a benefits application, fill it out right away and send it in. You may not be able to answer every question, such as "amount of medical expenses" if you haven't had any yet, just do the best you can and send it in immediately. Then, get the medical treatment you need. As long as the doctor signs that the treatment is medically necessary and related to the accident, you are covered. You can only recover financially from an injury if you have what is considered a "serious injury" as that term is defined by law. This includes death, miscarriage, fractures, a total disability that lasts 90 days or a permanent partial disability. The injury must be confirmed by objective medical proof such as an x-ray, MRI, CT scan or nerve conduction study.

The insurance company will definitely try to low ball you if you represent yourself. In my experience a settlement of 2 to 4 times the medical is a reasonable range on a soft tissue case with no need for surgery and clear liability. Nevertheless, all cases are unique so that is just a range. The insurance company will have to disclose how much insurance is available on the policy. The minimum in Texas is $30,000 for a non-commercial vehicle. If the truck that hit you is a commercial vehicle or business vehicle, then there is likely a larger policy limit.
