You have the right to sue the uninsured driver, but that probably will get you nothing. In Washington state you can file a claim with the DOL for them to prevent her from getting a new license until she satisfies your claim. First things first. Read and then re-read your actual policy language to see if your UIM coverage covers property damage (it usually does), and to make sure your insurance company isn't trying to cheat you in the process.
