How can I settle a minor personal injury claim against me out-of-court for cash? I ran over a woman's foot while driving uninsured. Thank you.

David B Harrison
Answered by attorney David B Harrison (Unclaimed Profile)
Personal Injury lawyer at Miller & Harrison, LLC
Has she filed a lawsuit? If so, most courts will require that the parties "mediate" with a third party mediator to see if they can resolve it out of court. If it has not been filed in court yet, you can contact her and see what she wants and negotiate from there. You will want her to sign a release, if you reach a settlement, in exchange for the check.  IF her insurance company compensated her, they may be entittled to repayment as well, so consider that. It is likely best to hire a lawyer to work through this with you to make sure it is done correctly.

How much should I ask for on my slip and fall personal injury case?

Answered by attorney Eugene Ray Critchett (Unclaimed Profile)
Personal Injury lawyer at E. Ray Critchett, LLC
Generally, it is impossible to advise you as to the likely value of your case simply on the facts as presented. There are a lot of other issues that need to be addressed first, such as whether or not the injury is permanent, whether you need additional treatment in the future, the amount of your medical expenses, whether or not you had health insurance, whether or not they have accepted liability, whether or not the insurance carrier is going to argue that you were partially at fault, whether or not you missed time from work, whether or not there were prior similar accidents etc . . . . I would recommend sitting down with an attorney in person to address these issues and to write down a list of your questions so that you do not forget during the meeting. You also should be aware that in Ohio, you may only have a two year statute of limitations to pursue this claim.

What should I do if I fell on a wet/slippery spot on a restaurant floor?

Mark Joseph Leonardo
Answered by attorney Mark Joseph Leonardo (Unclaimed Profile)
Personal Injury lawyer at Dordick Law Corporation
Every civil case has two components: (1) liability and (2) damages. Your damages seem nominal in the legal sense since you have not incurred any medical expenses. If you need them, get the care. The restaurant should have a med pay provision in their insurance policy to cover medical expenses regardless of fault. Hopefully you reported the incident to management before you left. As for liability, slip and fall cases are difficult. The hazard like this must be there for an appreciable period of time for them to know about it an clean it up. If another customer just spilled something and you slipped on it 10 seconds later, the restaurant will not be held liable. If was a grease spot that had been there for some period of time, it would be their obligation to clean it or place a warning of some kind in the area. I would need more details to provide any further advice. Buy you should not hesitate to contact a personal injury attorney in your area to get a free consultation to ascertain whether you have a case. If no attorney will take your case, then you should make a direct claim to the restaurant and ask what their med pay coverage is so you can seek the medical care you need.
