Can I sue a hospital for my miscarriage?

Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
There is no telling that the miscarriage could have been prevented. They did do the ultrasound and the blood work and made the correct diagnosis. As for sending you home, that may have been a violation of correct protocol and indeed that may have lead to the complications. However "may have" does not constitute legal proof, which in med-mal cases is quite expensive. So, it is possible that the case could be cost-prohibitive to pursue, even if meritorious. Meanwhile, you are stuck with this outrageous bill when they almost killed you. Complain to the State Board of Health. If the hospital sues you for the bill, counter-sue.

Can I sue the sheriff's department in small claims court for the damage done to my house?

That is a negligent thing to do, it is well known that if you don't step on the beams, that's what will happen. But why not just put in a claim with your homeowner's insurance?

Do i have a leg to stand on? tort or not?

Answered by attorney Victoria Wickman
Personal Injury lawyer at Law Office of Victoria Wickman
there is not enough information given. First was it colon cancer? What did the X-ray reveal? What information was withheld? Where was the treatment? If in New York, the statute of limitations may have run depending on whether there was continuous treatment by the doctor who had the chest X-ray results. Hope this helps.
