What are my rights if I was injured on the job due to my own negligence?

Answered by attorney Josh Lamborn (Unclaimed Profile)
Personal Injury lawyer at The Law Office of Josh Lamborn, P.C.
Your employer probably carries worker's compensation insurance, so you should be able to file a claim and have your medical and other bills covered. You are likely not able to sue the employer, even if the employer is negligent because the worker's compensation statute shields employers from lawsuits in Oregon. However, the saw you were using likely did not have a sawstop brake on it, or else you would not have lost your limb. You could bring a products liability claim against the saw manufacturer for failing to manufacture their saw with this device. Seek out a personal injury lawyer that specializes in products liability cases and schedule a consultations to discuss your case in more detail.

Can I sue

Answered by attorney Lori Nevias
Personal Injury lawyer at Lori Nevias, Attorney at Law
You can sue the murderer, but it is unlikely that you can successfully sue the club. The murder took place in your car, which is not club property. Even if it was parked in the parking lot of the business, unless you can prove that the former employee had a criminal history and the club owner knew or should have known of the employee's propensity for violence, the club will not be held responsible.

My car was hit by a stolen vehicle, is the owner insurance responsible for the repair?

Answered by attorney Steven A. Schwartz
Personal Injury lawyer at Joel H. Schwartz, P.C.
When a vehicle is stolen, the insurance is not valid because the owner never gave the driver permission. The only place you can go is your own policy if you have optional collision coverage.
