Generally speaking in a Virginia injury case, the at-fault person (usually through his insurance company) is liable to you for 100% of your medical bills (not just the part that your health insurance paid). This includes any prescriptions and anything you had to pay out of pocket, e.g., co-pays, bottle of Tylenol, heating pad; 2) your lost wages - even if your check stayed the same. If you missed work because of a doctor note or a medical appointment related to the accident.; and, 3) your pain and suffering. Quantifying pain and suffering is sometimes difficult. Right or wrong, my experience has been that the insurance companies seem to try to correlate your pain with your doctor bills, i.e., if you didn't go to the doctor; you weren't in pain. Permanent damage, such as a scar, can add more value to your case. I suggest you speak with an attorney who concentrates in personal injury.

Since you had no written contract the attorney will say you paid him a true retainer, which is a fee paid strictly to keep him available in case something happens, and is not an advance against future work. If it was the latter, at least part of it would be refundable. You could bring a small claims action which would most probably be referred to arbitration. You could try to negotiate and say, that you agree to pay him for the time spent in advising you and refund the balance or you will be forced to take appropriate action for return of your fee. You could also check the California Bar website for information for the public about attorney client fee disputes.
