You would have to try to re-open your old comp claim, though I don't know if that's procedurally possible to do. At a minimum, your doctor would have to state in writing that your current condition is due to the original accident.

He has until July 5, 2014 to file a lawsuit. It may depend on the insurance company as well as your attorney. Remember, he is getting nothing until you settle, so he probably is not dragging his feet. You can always call the bar association and tell them what is going on and find out if it makes sense.
