You will likely need to spend the money to retain a tenant lawyer to address this. I fyou don't have the resources for that you can try legal aid. If the older son has legal authority, such as a power of attorney, to sue for your removal from the property - you will likely find yourself in a bind because "mom said I could stay" is not a legal defense unless she is competent and comes to court to testify in your favor. Assuming you are an adult, absent some exigent circumstances, the remedy here is that you will need to move out and find your own place elsewhere. You DO NOT want the sibling to actually file an eviction lawsuit, as even if you won it, you will still have an eviction on your record making renting elsewhere even more difficult.

While I would not suggest initiating a claim on your own, however, if the insurance carrier for the other party is filing an action to recover the property damage against you would suggest that you file a counter claim for your property damage and any physical injuries you may have suffered, essentially asserting that the other driver was the cause of the accident.

Contact a supervisor in the hospital's billing department first. They are usually pretty good about getting money out of insurance companies. Depending on what they say, then contact your auto insurance adjuster-you should have 10,000 of med-pay coverage. You can negotiate with the health care providers who have balances after your health insurance pays. They will take dimes on the dollar on balances- then get the auto company to pay the lower bill you negotiated to make that 10,000 go as far as possible.
