First she sees her doctor because her health the most important thing in this matter. Then you have six months to file a claim for personal injuries with the city clerk. You can obtain the claim form on line or form the City Hall. If you do not file your claim within six months, you have lost your chance to file a claim.

You can sue the broker for negligence for his failure to procure an automobile insurance policy for you after you had provided him with all the required information. His negligence consisted of failing to send the company a clear copy of your driver's license when requested. The broker should have requested you to let him again fax the license to the company. Also, you have a case for misrepresentation when he sent the check back to the company and then told you that everything was fine and that you had insurance. The broker or insurance company should cover your damages.

Your first problem is there is a 3 yr statute of limitations. Sounds like you are too late to do anything. Is it your opinion that the screws were wrong or do you have an expert witness who says so?
